Oath of Office
Oaths seem to be an old fashioned idea, corny even. I can remember bringing up the Hippocratic Oath to a doctor once, and it fell to the pragmatic. I can remember my Boy Scout Oath and the Pledge of Allegiance as a child. There was even an oath for an official passport. But hey, who keeps those, right? Yet for some reason everybody has to take a pledge to support and defend the Constitution of US when they become an elected or appointed official of the federal government.
Brett Kavanaugh will have to take an oath if he becomes a Supreme Court Justice. He talks about looking for precedent in supporting the Articles and Amendments to uphold the intent of that document. That may well be, but this is the preamble of that document, this states the goal of all these Articles and Amendments:
“We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution . . . “
His nomination for the post and his pursuit of the post have demonstrated that he lacks clarity as to what will “insure domestic Tranquility . . . promote the general Welfare . . . to ourselves and our Posterity”. Almost half the Congress and about half the population do not want him there. That would seem to me to be falling flat on the “general Welfare” part as well as the “domestic Tranquility” issue. I am seeing no striving for that at all. And if these are the issues of which he and we are striving for to give to our “Posterity”, our children, then why would he drag his children into this turmoil of being nominated and sitting in the front row of his hearing? This shows, at the very least, lack of concern for his children’s “Tranquility”.
We need to look for a more tranquilizing nomination.
Donald J. Trump took the same oath. He too seems to have not made it past the preamble. He has ignored half the population of the US and avoided “domestic Tranquility”. He has not promoted the “general Welfare” but just his voting block and supporters and he has certainly demonstrated his lack of concern for his “Posterity”, his children, by putting them front and center in this turmoil with no regard to their legal jeopardy. After all, he trained them in this casual disregard for truth and honorable, fair business practice. It would have been better to have left them out of the public eye.
I think it might be time for all of us to give up this corny idea of oaths. They seem to mean nothing to anybody, anymore. When there seems to be no regard to integrity, truth, or underlying moral imperatives to oaths, or even laws anymore, people are just taking and breaking them not for our “general welfare” but just for their own “Posterity” and profit. Why bother? People are being encouraged to accept role models who will do anything to claw their way to the top, and those who wind up on the base of that pyramid wind up in the service industry.
If the Articles and Amendments of the Constitution are being supported by precedent, but are not achieving the intent outlined in that preamble, then no amount of precedent or word play is going to achieve the “general Welfare”.
